AREA 6 END-USER LICENSE AGREEMENT

NOTICE

This End User License Agreement is current as of November 25, 2020 and supersedes any other agreement, including any others previously presented on this site or included within deliverables.

What we've changed: the rights granted for products we create and sell directly remain the same. We did some minor editing to make things a little more clear and to emphasize that these rights apply only to products we sell directly through the AREA 6 website via the Gumroad platform.

READ THIS LICENSE CAREFULLY. IT IS A LEGAL AGREEMENT BETWEEN YOU/YOUR EMPLOYER AND AREA 6.

If you are accepting on behalf of your employer or the entity that is purchasing the Digital Media Files, you represent and warrant that you have full legal authority to bind your employer or such other entity. If you do not have such authority or you do not accept or agree with these terms, do not accept the Agreement and do not download the Digital Media Files.

BY USING AREA 6 (“Digital Media Files”), WHETHER VIA DOWNLOAD, ON CD ROM, DVD OR OTHER MEDIA, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

Definitions

The Digital Media Files are any images, animations, films, videos or other audio/visual representations recorded in any format that are sold directly by AREA 6, and not through a publishing platform such as Adobe Stock or Pond5. Their EULAs differ substantially from this one.

Grant Of License

Upon purchase of the Digital Media Files, you are granted a non-exclusive, non-transferable license to use and modify the Digital Media Files subject to the following terms and conditions:

Single Use License

The Digital Media Files may only be modified or used in unmodified form, on one computer at any one time. You may not rent, lease, lend, sell, sublicense or otherwise share the Digital Media Files with any other person, company or entity. Please contact AREA 6 for a multi-seat site license if you need to use the Digital Media Files over a network for multiple users.

Please don't share. Our products are very fairly priced and we make a living creating and selling them.

Non-Retail Uses

The Digital Media Files may be incorporated into a derivative work such as a film, video, broadcast, digital/multimedia title, advertisement, live performance, internet presentation or print project, but the Digital Media Files themselves may not be sold, licensed, reproduced, distributed or displayed as stand-alone artwork, stock or effects imagery elements, made available as downloadable files or included in any other clip media/stock product, library, collection or set of assets for distribution or resale. These terms apply even if the Digital Media Files have been significantly altered.

When Using Our Digital Media Files To Make Derivative Works or Products:

The Digital Media Files may be used in derivative works intended for multiple resale, including retail products and stock imagery and footage, with the following limitations: The Digital Media Files may not comprise more than 20% (by length, number or percentage) of the total imagery used in the finished work, nor may the primary value of the product or stock imagery/footage come from the Digital Media Files.

Additionally, you agree to take all steps necessary to prevent any third party from accessing, duplicating or distributing any of the Digital Media Files included in the derivative work. For example, rendering a video which includes our Digital Media Files prevents third parties from accessing the Digital Media Files themselves. Please note that special licensing to obtain additional rights is available by contacting AREA 6.

Indemnification and Limitation of Liability

You agree to indemnify and hold harmless AREA 6 and all of its officers, directors and employees (“Those Indemnified”) for any and all losses, damages, liabilities, claims, costs or expenses including reasonable attorney's fees incurred directly or indirectly by Those Indemnified in connection with the use of the Digital Media Files or AREA 6 web site.
